Do your due diligence

It can often be the case that when sub-contractors win a project, they pat themselves on the back, check that the contract sum is right and quickly sign and return the contract without studying the terms and conditions.


In current times where main contractors' margins are squeezed due to cost inflation, they are often looking for ways to protect that margin and this can be done by many ways, one of them being using the terms of the sub-contract to contracharge their sub-contractors.


Recently we have been working with a handful of sub-contractors who been signing sub-contracts without any due diligence and already they have seen what risks they have been leaving themselves open up to. We are now reviewing each sub-contract that they win so that they know what is being expected of them. This then allows them to query conditions that they would have previously simply accepted.


Depending on the complexity of the sub-contract, the cost of this review process can be as little as a couple of hundred pounds, something that we see as being a worthwhile investment given the potential risks involved.
